ANAHEIM, CA - (September 11, 2003) – The following information is being provided by the City of Anaheim’s Fire and Police Departments in order to update the media of the on-going investigation of the September 5 accident at the Disneyland Resort.

· The Anaheim Police Department’s investigation of the accident of the Big Thunder Mountain Railroad attraction continues. The California Division of Occupational Safety and Health (Cal/OSHA) also continues to investigate this incident. It is anticipated that these investigations may continue for several months. The Anaheim Police Department will not conclude its investigation until the Cal/OSHA investigation is complete, as information in their report will assist Anaheim police in their investigation. At this point, Anaheim police investigators have no evidence to indicate that this event was anything other than a tragic accident.

· A 9-1-1 call was received by the Anaheim Fire Department. The content of the initial call and the subsequent communications between the Fire Department, the Anaheim Police Department and Disneyland are part of investigatory files of the Anaheim Police Department. As a part of the initial investigatory process, the content of these communications will be temporarily withheld from disclosure. There was no 9-1-1 call received by the Anaheim Police Department.

· Though we appreciate the media’s interest in the human side of this story, first responders such as paramedics, fire and police personnel will not be available to speak to the media because of their involvement in the investigation.

· In accordance with medical privacy laws and laws protecting other private information, the City does not have the authority to release medical or other private information about patients to the public without authorization from the patients or their representative, unless release of the information is compelled by a court of law or other judicial or administrative processes.
