A friend of ours is a DVC member and he said he claims on his taxes yearly the fees he pays at DVC... like it is real estate property....
is this true... can you leagally do this?

It is true that part of your maintenance fees do go to pay for property taxes, but it is only a portion of the entire fee structure. When you get your statement, it will break it down between taxes and other categories. Capital Reserves Budget and Operating Expenses are the other two categories. As an example, for my 2008 annual fees, the tax rate was $0.9785 per point.

Depending on your own specific tax situation, you may be able to claim a certain amount of your annual fees on your tax returns. To find out what you may be able to do in your situation, you should contact your tax adviser.

Yes, but fees for maintenance are not deductable.
