How can CBS (or anyone) claim to have an exclusive on videography of this type? Based on this, New Line is also guilty due to much aerial in Lord Of The Rings.

It is the combination of items.

For example, the Amazing Race also features the aeriel shots, but uses many different locations, and plays a totally different game.

The problem of the "I'm a Celebrity", is that it seems to be Survivor games, in a Survivor location, using similar filming techniques, but with Celebrities instead of "average" folks.

Survivor is claiming it looks like and feels like Survivor, and that is copyright infringement.

Which might force the "I'm a Celebrity" people to make more changes to make it less like Survivor (but if they do that, will they get the same ratings?).

Eactly. I can use the words: times, best, of, it, worst, etc. in something I write and not have a problem. However, if I start a book "It was the best of times, it was the worst of times," I might be running into some issues. Individual elements make not cCopyright infringement. Combining a variety of individual elements, however, to produce a show that mimics the original in an attempt to capitalize off of the popularity of the originial, is rather questionable.
